2. The Placetel website
You can use a large part of the Placetel website without providing us with any concrete information about yourself. We only collect certain usage data and this information will be stored separately from any other data you may provide to us.

Microsoft Advertising For our online marketing measures, we also use the Microsoft Advertising program of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA. This is a Microsoft advertising program that is based on a pay-per-click system. This means advertisers can place ads on the Bing and Yahoo! search engines and only pay when a user clicks on the ad. We have integrated a conversion tracking day from Microsoft Advertising into our website. This is known as the Universal Event Tracking (UET) Day. 3. Use of personal data when purchasing and using Placetel products
Placetel offers different products for which different types of personal data are required and collected. This concerns, among other things, the operation of a „telephone system in the cloud“, the establishment of telecommunication services and the purchase of terminal equipment.
The telecommunications services offered by Placetel (in particular the establishment of telephone and fax connections) are partly available in a bundle with other offers, but are provided separately with regard to personal data. The data collected and used when using telecommunications services is not merged with other data.
Where Placetel provides cloud-based services, including our “telephone system in the cloud”, Placetel acts exclusively as the customer’s data processor within the framework of a contract concluded with the customer.
This privacy statement only relates to data processed by Placetel as a controller when providing the telecommunication services.

Contract-related data (e.g. name, company name, address, etc.) is stored insofar as this is necessary for the establishment, content or modification of the contractual relationship. Personal data will not be passed on to third parties without your express consent or without Placetel being required to do so by law or in accordance with contractual requirements. After termination of the contractual relationship, the subscriber data will be deleted at the end of the calendar year following the termination. In the event of any longer statutory storage obligations, access to the data will be blocked instead of deleting the information. We collect and process in particular:
• Contact data, such as first and last name, company name, telephone number(s), e-mail address(es), address, commercial registration number, name and first name of contact persons in the company, tax number
• Contract master data (contractual relationship, product or contract interest)
• Contract billing and payment data, such as method of payment, the applicable credit institution with the account number, the account holder, etc.
• Customer history
• Planning and control data
• Information (from third parties, e.g. credit agencies or from public directories
• Other data provided to us as subscriber data
As a registered customer, you can view and administer your subscriber data/contract data at any time on the Placetel portal. As a customer, you have the right to request information from us at any time about the data we have stored about you, as well as about its origin, recipients or categories of recipients to whom this data is passed on and the purpose of storage.
If we use your data for marketing purposes, you can object to the use of your personal data at any time and free of charge. You can send objections by e-mail to info@placetel.de.
By order of the competent authorities, Placetel may, in individual cases, provide information about subscriber data if this is necessary for the purposes of criminal prosecution, for police and national security purposes to the police authorities or for the enforcement of intellectual property rights.
3.2 Subscriber data for telecommunications services
In addition to the above-mentioned general requirements for data collection when concluding and processing contracts, the following applies to telecommunications services (e.g. telephony, fax) and the subscriber data that is generated in the process. Placetel stores the subscriber data of the customers in order to meet legal storage obligations, for the purposes of providing advice to customers, to advertise our own offers, for market research and to inform other users about individual call requests and for billing purposes. This applies in particular to the following data:
• the telephone numbers and other connection identifiers,
• the name and address of the subscriber,
• for natural persons, their date of birth,
• in the case of fixed network connections, also the address of the connection,
• in cases in which a mobile telephone terminal is provided in addition to a mobile telephone connection, the device number of this device, and
• the date of commencement of the contract.
Placetel will store this data for up to 6 months after the end of the contract. After this period, they will be deleted or, if the data must remain stored to fulfil other legal obligations, blocked. You can object at any time to the use of your data for customer advice and for advertising your own offers, for market research and for informing other users about individual meeting requests (see above).
3.3 Traffic data/usage data for telecommunications services
Where a telecommunications service is used, we will collect and use traffic data (this is data collected, processed or used in the course of providing this telecommunications service) only for the purposes permitted by law. The collection, processing and use of traffic and usage data is carried out in particular for the purpose of billing, for marketing and for the demand-oriented design of telecommunications services or for the provision of value added services, for the detection and elimination of faults and errors, for the detection and prevention of service fraud and other illegal use of the services offered by Placetel and, if applicable, for the fulfilment of legal storage obligations. Traffic data is only used to the extent prescribed or permitted by UK law.
The traffic and usage data collected includes in particular the following data:
• Identification of the customer,
• the number or identification of the lines involved,
• Start and end of the respective connection by date and time
and, to the extent that the remuneration depends on it in each case,
• the amount of data transmitted,
• the telecommunications service used by the user,
• the end points of dedicated connections,
• Start and end of connections by date and time,
• the quantities of data transmitted,
• other traffic data necessary for the calculation of charges.
Placetel may transmit usage data for billing purposes (billing data) to other providers or third parties, as far as this is necessary for customer billing purposes.
Traffic data that is not used for billing purposes is deleted immediately after the end of the call unless we are required by stature to retain the data for a longer period, in which case access to the data will be blocked.
We store the traffic data used for billing purposes for 6 months after the sending of the invoice, unless the data has to be stored for a longer period of time in exceptional cases to clarify objections. If the customer has raised objections to the invoiced charges, Placetel is entitled to store the traffic data/user data until the objection has been finally clarified.

3.4 Data protection-related choices in telecommunications services
Within the framework of telecommunications services provided by Placetel, you have several choices:
• Directories of subscribers: At the customer’s request, Placetel will arrange for the inclusion of the customer’s telephone number(s), name, address and additional information such as profession, industry and type of connection in public subscriber directories. The customer can decide which information is to be published in the directories. The Customer may object to this entry at any time.
• Telephone directory enquiries: If the customer has applied for inclusion in a subscriber directory, a provider of telephone directory enquiries services may provide information on this personal data, provided the customer has not objected to this provision of information.
• Reverse search: The Customer has the right to object to the provision of his and his co-users’ name and address on the basis of his telephone number (reverse search).
• Calling Line Identification: Placetel telecommunications services offer the possibility of suppressing the presentation of the calling line identification to the called subscriber, either permanently or on a case-by-case basis, provided that the terminal equipment supports this feature. Placetel activates calling line identification by default. The same applies to the display of the calling line identification for call forwarding and the display of the numbers of calling persons. If the customer wants to deactivate one of these service features, this setting can be changed in the customer portal.
• Connected line identification: At the Customer’s request, Placetel will provide, at no additional cost, a special line where the transmission of the number of the line from which the call originates to the called line is excluded (for example, to provide anonymous helplines or whistleblower lines).
• Itemised bill: If the customer requests itemised bills, the numbers called can be displayed in full or abbreviated by the last three digits. If he does not exercise his right to choose (by email to info@Placetel.de), we will save the destination number in full. Depending on your choice, the data on the dialled numbers will remain stored at Placetel at least until the itemised bill is created. The itemised bill will only be made available to the customer if he confirms that he has informed any users concerned and, if available and necessary, that the works or staff council has been involved.
3.5 Data protection for the telephone system in the cloud
Placetel provides the customer with a virtual telephone system from the cloud. Processing of personal data in this regard is done on behalf of the customer, separately from data processing for other services. For this processing, the data processing agreement between us and the customer applies.
4. Privacy Statement for Business Partners and Suppliers
At the time you enter into a supply and/or business partner contractual relationship with us, we generally collect personal data such as first and last name, business e-mail address, address, telephone/mobile number as well as information that is required for the initiation, execution of the contract or for consultation purposes. We need this data to be able to identify you as a supplier or business partner, to prepare and conclude the contract and to contact you. In addition, we need the data for billing purposes and to enforce any claims against you.
The data processing takes place on your request and/or your order and is in accordance with Art. 6 para. 1 S. 1 lit. b GDPR for the aforementioned purposes and the processing is mandatory for the fulfilment of your order and the obligations arising from the contractual relationship. The personal data collected will be stored until the expiry of the contractual relationship and will be deleted thereafter, unless we are obliged in accordance with Art. 6 para. 1 S. lit. c GDPR based on legal storage and documentation requirements (from DGVO, BDSG-new, HGB, StGB, AO etc. ) to a longer storage period or you have according to Art. 6 para. 1 S. 1 lit. a GDPR consented in a longer processing period. A transfer of your personal data to third parties for purposes other than those listed here will not take place.
We will only transfer your personal data to the extent necessary for the implementation of the contractual relationship to operating companies involved in it (e.g. IT service providers, payment service providers, authorities, banks). Any further transfer of your data or processing for purposes other than those mentioned here, as well as the sale of your personal data, will expressly not take place.
We have taken appropriate technical and organisational measures to ensure an adequate level of security and confidentiality of your personal data.
5. Miscellaneous
5.1 Consulting, advertising, market research
Subscriber and contractual data that Placetel collects will only be used within the framework of the applicable laws, regulations and guidelines. The transfer of this data to third parties for consulting, advertising and market research purposes is only permitted with the explicit consent of the customer.
5.2 Credit assessment
Placetel may transmit customer data (company name, address) to a credit check company/reporting agency for the purpose of address verification and credit assessment. The credit auditing company/reporting agency commissioned by Placetel may make available the address and creditworthiness files stored in its database on relevant individuals to Placetel, including those determined on the basis of mathematical-statistical methods. We also use part of the subscriber data for this purpose.
Placetel may also pass on the customer’s data about any non-compliance with contractual obligations - such as in case of termination due to default of payment or foreclosure measures. If, during the contractual relationship, such data from other contractual relationships in which the customer is involved is collected by the credit investigation agency/accountancy office, we can obtain information about this.
5.3 Right to information
Upon request, Placetel will provide the customer with information about the personal data stored about him/her in accordance with the GDPR. If you request information about the personal data stored about you by Placetel, you can contact the data protection officer in writing. Please contact the data protection officer for information using the information contained in Section 1.
5.4 Right of objection
If your personal data are processed on the basis of our legitimate interests, you have the right to object to the processing of your personal data, if there are reasons for doing so arising from your particular situation
You also have a general right of objection in relation to the processing of personal data used by Placetel for direct marketing, which will be implemented by us without indicating any special situation.

5.6 Data portability
If your data processing is based on consent or a contractual relationship, you can request that this data be handed over to another provider in a common, structured and machine-readable format at any time.
5.7 Right to rectification
As a data subject, you have the right to request the rectification of inaccurate personal data without undue delay. Taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data.
5.8 Right to erasure („right to be forgotten“)
As a data subject, you may have a right to erasure. This is the case, for example, if your personal data is no longer necessary for the original purposes, you have revoked your declaration of consent under data protection law or the personal data was processed unlawfully.
5.9 Right to restriction of processing
As a data subject, you have the right to restrict processing in the cases prescribed by law (for example, where you contest the accuracy of the personal data and we are in the process of verifying the data).
5.10 Right to complain to a data protection authority
You have the right to complain to a supervisory authority, in particular in the Member State of your residence, workplace or the place of the suspected infringement, if you consider that the processing of personal data concerning you violates the GDPR.
5.11 Data disposal
The disposal of electronic data storage devices and paper-based documents is only carried out by service providers who guarantee certified destruction in accordance with applicable data protection law.
